Terms of Use

These Terms are an agreement between you and Emberlitt, Inc. ("Emberlitt", "we", "us"), which operates Courtbird, the app and website that help tennis players find partners, groups, coaches and courts. By creating an account or using Courtbird you accept these Terms and our Privacy Policy. If you don't agree, don't use Courtbird. Please read section 12: it limits how disputes are resolved.

1. Who can use Courtbird

There is zero tolerance for objectionable content and abusive users. You agree not to:

Every profile, photo, message, invite and group can be reported, and any user can be blocked instantly. Group organisers can also delete messages in their group's chat and remove members from their group. We review reports within 24 hours and may remove content, suspend or ban accounts, and share information with law enforcement where the law allows or requires.

3. Your content

You own what you post (photos, profile, messages, results). You give us a worldwide, non-exclusive, royalty-free licence to host, store, display and share it inside Courtbird, and to show it in the share cards you choose to create, only to run the service. The licence ends when you delete the content or your account, except for copies other people already shared outside the app and backups kept for a limited time. You confirm you have the rights to everything you post, including permission from people shown in your photos.

6. Ratings, results and badges

Birds Rating, levels, badges and kudos are for fun and have no monetary value. Results count only when both players confirm them. We may adjust or remove ratings, results or accounts that game the system.

7. Third-party services

Courtbird uses or links to services run by others, including Apple, Google (Firebase and Maps), OpenStreetMap, Open-Meteo, Instagram, WhatsApp, Telegram and Signal. Their own terms and privacy policies apply when you use them, and we aren't responsible for them.

8. Our service and intellectual property

Courtbird is currently free. The app, its name, bird mascot, design and code belong to us or our licensors. These Terms give you a personal, non-transferable, revocable licence to use the app for its intended purpose. We may change, add or remove features, introduce optional paid features or paid promotion in the future, or discontinue the service. Any paid feature will be optional, clearly labelled, with the price and terms shown before you pay, and sold in line with consumer-protection and tax laws and the App Store and Google Play rules (including their refund policies). Promoted content will always be marked as promoted.

9. Disclaimer of warranties

COURTBIRD IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OR AVAILABILITY, TO THE MAXIMUM EXTENT PERMITTED BY LAW. Some places don't allow these exclusions, so some may not apply to you.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMBERLITT, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES AND OWNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF DATA OR PROFITS, ARISING FROM YOUR USE OF COURTBIRD OR YOUR CONDUCT OR INTERACTIONS WITH OTHER USERS OR COACHES. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF USD 100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Nothing in these Terms limits liability that cannot be limited by law (for example for death or personal injury caused by our negligence where such a limit is not allowed, or for fraud), or your statutory rights as a consumer.

11. Indemnity

You agree to defend and hold harmless Emberlitt, Inc. and its officers, directors, employees and owners from claims, losses and costs (including reasonable legal fees) arising from your content, your use of Courtbird, your interactions with other users, any lessons you give or take, or your breach of these Terms or the law, except to the extent caused by us.

You can delete your account anytime in Profile → Settings → Delete account. We may suspend or end your access if you break these Terms, create risk for others or for us, or where required by law. Sections 3 (as to licences already granted), 4, 5, 9, 10, 11 and 12 survive termination.

14. App Store and Google Play

If you got Courtbird from Apple's App Store: these Terms are between you and Emberlitt, Inc., not Apple; Apple has no obligation to provide maintenance or support; Apple is not responsible for warranties, product claims, legal compliance or third-party intellectual property claims relating to the app (to the extent a warranty fails, you may notify Apple for a refund of any purchase price, which is zero); you confirm you are not in a country subject to a U.S. embargo or on a U.S. prohibited-parties list; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use must also follow Apple's Usage Rules. If you got Courtbird from Google Play, Google Play's terms also apply.

15. Copyright complaints

If you believe content on Courtbird infringes your copyright, email us with: your contact details, the work, the exact content and where it appears, a statement of good-faith belief that the use is unauthorised, a statement under penalty of perjury that your notice is accurate and that you are the owner or authorised to act, and your signature. We remove infringing content and close repeat infringers' accounts.

16. Changes and general terms

We may update these Terms. If a change is material we'll tell you in the app or by email before it takes effect; continuing to use Courtbird afterwards means you accept it. If any part of these Terms is unenforceable, the rest stays in effect. Not enforcing a provision isn't a waiver. You can't transfer these Terms; we may transfer them as part of a reorganisation or sale. These Terms and the Privacy Policy are the entire agreement between us about Courtbird.
